Mystart11

Mystart11 is the flagship brand of EDDBEE GROUP INDIA Private Limited (“Mystart11”). All of Mystart11, with its subpages and the Mystart11 mobile App, operates two separate portals through which it offers cricket-based and football-based online fantasy games. Mystart11, as used here, shall be collectively referred to as Mystart11 and the Mystart11 App

Mystart11 operates within the laws and legislation of the Government of India and abides by the Constitution. Accordingly, no clause included in these Terms and Conditions shall limit Mystart11’s right to comply with governmental, court, and law-enforcement requests or requirements pertaining to Users’ use of Mystart11.

Using Mystart11

All persons (“User“) using Mystart11 or the Mystart11 App (‘Mystart11 platform’) to participate in various contests and games (including fantasy games) available on the Mystart11 platform (“Contest(s)“) (‘Mystart11 Services’) will be mandatorily obliged to adhere to the Terms and Conditions, and all other rules, regulations and terms of use referred to herein or otherwise provided by Mystart11 in relation to any Mystart11 Services.
Use of Mystart11 includes the User’s acceptance of such Terms and Conditions, rules, regulations and terms of use referred to herein or otherwise provided by Mystart11 in relation to any Mystart11 Services, as may be amended from time to time.
Some Mystart11 Services provided on the Mystart11 platform may be subject to additional terms, conditions, rules and regulations set down in that respect. To the extent that these Terms and Conditions are inconsistent with the additional conditions set down, the additional conditions shall prevail.
At its sole and absolute discretion, Mystart11 may:
- Restrict, terminate or suspend any User’s access to all or any part of Mystart11 or Mystart11 Platform Services;
- Alter, suspend, or discontinue all or any part of the Mystart11 Platform Services;
- Reject, move, or remove any material submitted by a User;
- Move or remove or edit any content that is available on the Mystart11 Platform;
- Deactivate or delete a User’s account and all related information, including files on the account, in case of proven or suspected fraudulent activities;
- Give discounts to users in the form it deems fit (“Cash Bonus“) that shall be credited in a separate account called a Cash Bonus Account which can only be redeemed to pay contest joining fees.
- Assign its rights and liabilities to all User accounts hereunder to any entity (post such assignment, intimation of such assignment shall be sent to all Users to their registered email ids)

User Account Suspension

In the event of User breaches, or Mystart11 reasonably believes that a breach of Terms and Conditions has occurred, or that the User has illegally or improperly used Mystart11 or the Mystart11 Services, Mystart11 may, at its sole and absolute discretion, without any notice to the User, restrict, suspend or terminate such User’s access to all or any part of Mystart11 Contests or the Mystart11 Platform, deactivate or delete the User’s account and all related information on the account, delete any content posted by the User on Mystart11 and further, take technical and legal steps as it deems necessary.

Legality of Mystart11

Like all fantasy sports, Mystart11 is legal as it is classified as Games of skill under the Indian jurisdiction. Games of skill are legal, as they don’t come under the ambit of Indian gambling legislations, including the Public Gambling Act of 1867.
The Indian Supreme Court, in the cases of State of Andhra Pradesh v. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan v. State of Tamil Nadu (AIR 1996 SC 1153), has stated that any game in which success is determined primarily upon the superior knowledge, training, attention, experience and adroitness of the player shall be classified as a game of skill.
The Contest(s) described above (across the Mystart11 Services) are “games of skill” as the success of Participants is predominantly determined by their superior knowledge of the games of cricket and/or football and/or knowledge of players’ relative and/or players’ performance in a particular territory, conditions and/or format (such as T20, ODIs, and test cricket in the cricket fantasy game), attention and dedication towards the Contest(s) and adroitness in playing the Contest(s).
All participants of any Mystart11 Contest(s) mandatorily acknowledge and accept their participation in a game of skill.

Player Eligibility

Persons must be above the age of 18 years and currently residing in India.
Persons residing in the “restricted” Indian states of Andhra Pradesh, Assam, Nagaland, Odisha, Sikkim or Telangana may not participate in the paid version of the Contest (s) as the laws of these states are unclear and bar persons from participating in games of skill where participants are required to pay to enter.
Persons must have a valid email address to participate in Contest (s).
Mystart11, on receipt of information regarding a person with insider knowledge of participating teams in any given contests/match, organizing boards, leagues, etc., may immediately bar him/her from participation and/or withdrawing winning prices.
Employees of Mystart11, its parent companies, subsidiaries, associate companies, and third-party service providers engaging with Mystart11 for the development, promotion, administration or execution of the Contest and their family/household members are not eligible to participate in the Contest.
Only those Participants who have successfully registered on the Mystart11 as well as registered prior to each match in accordance with the procedure outlined above shall be eligible to participate in the Contest (s).

Service Disruptions

Users may face service disruptions due to but not limited to:
- Server maintenance
- Third-party service being down
- Deployment of new versions
- Issues in the hardware-software used by you
- By you using an older version of the platform
You understand that Mystart11 has no control over these factors and thus is not responsible for any risk of loss. It is assumed that Users consider these factors before participating in any Contest(s).
Mystart11 shall attempt its best to restart the game immediately once the minimum number of players joins the game. However, a fixed time cannot be committed. The commencement and conclusion of fantasy sports games shall always be aligned with the timing of the respective live sports events.
Mystart11 specifically disclaims any liability whatsoever towards the User when there is no money paid by him/her.
You agree that under no circumstances shall you hold Mystart11 liable to pay you any amount over and above the service charges for any of the instances mentioned above.
You acknowledge and agree that in cases wherein you were unable to play/participate in any game/contest/competition due to an error or problem pertaining to Mystart11 or otherwise, you shall only be reimbursed as per the Game Cancellation Settlement Policy as given under.

Game Cancellation and Refund Settlement Policy

Users will receive a full refund 5 to 7 working only if one or both of the following apply :
- In the case where the match gets abruptly abandoned, canceled, or postponed.
- In the case where a contest is not guaranteed and the required spot(s) do not get filled.
- In the case where the spots in a Private contest do not get filled.
- In the case of any inaccuracies in the data provided by a third party provider.

Payment Terms

In respect of any transactions entered into on the Mystart11 platform, including making payment for participating in the paid versions of Contest(s), Users agree to be bound by the following payment terms:

Subject to these Terms and Conditions, all amounts collected from the User are held in a separate non-interest earning bank Account. The said accounts are operated by a third party appointed by Mystart11 for these Terms and Conditions. From these bank accounts, the payouts can be made to (a) Users (towards their withdrawals) and (b) the Government (towards TDS on Winnings Amount). Mystart11 receives only its share of the fees through the said Escrow Agent.
In instances where the User indulges in a game where the money of multiple users is pooled in Cash Pool to offer to the winner, it shall be duly noted that Mystart11 has no right over or interest in this pooled money (Cash Pool). The money shall get debited from the User’s account balance maintained with the trustee.
Mystart11 users get two types of accounts for processing and reconciliation of payments: (i) Unutilized Account and (ii) Winnings Account. It is clarified that in no instance the transfer of any amounts in the User’s accounts to any other category of account held by the User or any third party account, including a bank account held by a third party shall be allowed.
- The user’s winnings will be credited to the User’s Winnings Account.
- User’s remitting the amount through the designated payment gateway shall be credited to User’s Unutilized Account’.
Each time a User participates in any contest on the Mystart11 platform, the pre-designated amount shall be debited in the User’s Unitized account, and any remaining amount of participation fee shall be debited from the User’s Winning Account.
In case any amount added by the User while participating through a payment gateway exceeds the remaining amount of the pre-designated amount, the excess amount will be transferred to the User’s ‘Unutilized’ Account, which can be used in participation in any match(s) or Contest(s).
Debits for the purpose of enabling a user’s participation in a Contest from the ‘Unutilized’ Account will be made in order of the date of credit of amounts in the ‘Unutilized’ Account, and in the same way, amounts credited into ‘Unutilized’ Account earlier in time shall be debited first.
The Users are required to utilize all credited amounts into the User’s ‘Unutilized’ Account within 335 days of credit. Beyond that, Mystart11 reserves the sole right to forfeit such an amount.
Withdrawal from Winnings Account shall be made after a request to Mystart11. The company shall then start an online transfer to the User’s bank account within a commercially reasonable time frame.
Mystart11 does not charge any processing fee for the online transfer of amounts from the Winnings Account to the User’s bank account. It is mandatory to provide valid photo identification and address proof documents for Mystart11 to process the withdrawal request.
The name on the User’s photo identification document should match with the name provided during registration on Mystart11, along with the name and address existing in the records of the User’s bank account as provided to Mystart11. In the following cases, Mystart11 shall not transfer any Winning amounts to the User:
- The User has registered no bank account with Mystart11.
- The User has not verified his/her User’s bank account with Mystart11, to the satisfaction of Mystart11’s and the Terms and Conditions.
- The User has not verified his/her PAN card with Mystart11.
For promotional initiatives, Mystart11 may issue Cash Bonus to the User to urge participation in Contest(s) through coupons. Users are not permitted to transfer or request the transfer of any amount into the Cash Bonus. The use of Cash Bonus shall be restricted and limited, such as to the time within which such Cash Bonus must be used. Issuance of Cash Bonus to the User is subject to the sole discretion of Mystart11 and shall not be demanded by any User as a matter of right, subsequently, at any time or create an expectation of a specific amount of recurring issuance of such Cash Bonuses. The Cash Bonus offered can be used to contribute to the Cash Pool in any Contest, following these Terms and Conditions. Moreover, this Cash Bonus shall not be transferrable or withdrawable to any other account of the User, including his/her or others’ bank account, other than as part of a User’s winnings in any Contest(s). If the User wishes to terminate his/her account with Mystart11, or if such account is terminated by Mystart11, all Cash Bonus granted to the User shall return to Mystart11, and the User shall not possess any right or interest on such points whatsoever.
- All Cash Bonus coupons credited to the User account shall be valid for the said number of days as mentioned in the coupon from the date of credit.
- Users agree that once they confirm a transaction on Mystart11, they shall be bound by and dutifully make payment for that transaction.
- The User acknowledges that the time taken for bank reconciliations and other external dependencies that Mystart11 has on third parties or any transactions on the Mystart11 Platform may take up to 24 hours to be processed. Any amount transferred or paid into the User’s ‘Unutilized’ Account or Winnings account and utilization of the Cash Bonus or money debited from the ‘Unutilized’ Account or Winnings Account might take up to 24 hours to reflect in the User’s or Winnings Account or Unutilized Account balance.
- The User agrees that in instances of any lost opportunity to join any match or Contest due to delayed crediting of transaction amount into any of the User’s accounts shall not make Mystart11 liable.
- A transaction, once confirmed, is final, and no cancellation is permissible.
Mystart11 may refund the amount to the User after deducting applicable cancellation charges and taxes in some exceptional circumstances and at its sole and absolute discretion. Moreover, these transactions will be subject to additional terms and conditions. To the extent that if these additional terms and conditions contain any clause that conflicts with the current terms and conditions, the additional terms and conditions shall prevail.

Tabulation of Fantasy Points

Mystart11 may obtain the score feed and other information required for the computation and tabulation of fantasy points from a licensed third-party service provider(s) or the official website of the match organizer. Under rare circumstances where there is an error in the calculation or tabulation of fantasy points, abandonment of a match, and selection of winners due to inaccuracies/incompleteness of the data provided by the official website of the match organizer and third-party service provider, Mystart11 shall make all efforts possible to rectify such error before prices are distributed.
It is to be duly noted that though Mystart11 relies on a high level of accuracy and completeness of its third-party scores and statistics inputs, it does not warrant or make any representations regarding the accuracy of the inputs. In cases of inaccuracies in computation and tabulation of fantasy points or the selection of winners because of inaccurate or incomplete scores and statistics received from the third-party service provider, Mystart shall not be held responsible. Users and Participants acknowledge and agree not to make any claim or raise any complaint against Mystart11 in this regard.

Selection of Winners and Conditions for Prizes

Winners will be decided based on the Teams’ scores in a designated match (which might last between a day to an entire tournament) of the Contest(s). The Participant(s) who owns the Team(s) with the highest total points in a specific match shall be declared the winner(s). In certain pre-specified Contests, Mystart11 might declare multiple winners and offer prizes to them in increasing order of their Team’s total score at the conclusion of the designated match of the Contest. The considered number of Winners and the price for each winner(s) in such Contest shall be as specified on the Contest page before the beginning of the Contest.
Creating Teams on behalf of other Participants or persons is prohibited, and doing so may result in disqualification.
In case when a game ties, the prize shall be equally divided among the winning Participants.
Mystart11 will refrain from paying any prize to the winner(s) if it is discovered that the winner(s) have not abided by these Terms and Conditions and all the other rules and regulations about using the Mystart11.

Contacting Winners

Winners shall be contacted by the email address provided at the time of registration by Mystart11 or the third party conducting the Contest. The verification process and the documents required to collect the prize shall be detailed to the Winners at this stage. As a standard protocol, winners will be required to provide the following documents:
- Photocopy of the User’s PAN card
- Photocopy of User’s bank details.
The winner(s) shall not be able to withdraw his/her prize(s)/accumulated winning amount unless the required documents mentioned above have been received and successfully verified within the time stipulated by Mystart11. Furthermore, the user agrees to the originality of the documents provided during the verification process.
In case when the winner(s) fail to check their email, resulting in a non-communication of their winnings, Mystart11 shall not be responsible for the same.
If a Participant has been declared a winner on the app, but has no email receipt of the same from Mystart11, such Participant may contact Mystart11 within the time specified on the webpage at support@mystart11.com.

Verification Process

Mystart11 shall verify all documents submitted by the User and at its sole discretion, disqualify any Winner(s) from withdrawing the accumulated winning amount (or any part thereof) in the following cases:

The document or any information submitted by you is incorrect, misleading, false, fabricated, incomplete or illegible.
You do not fulfill the eligibility criteria to participate in the game.

Only those Winners who successfully complete the verification process and provide the required documents within the time limit specified by Mystart11 shall be permitted to withdraw/receive their accumulated winnings (or any part thereof). Mystart11 shall not entertain any claims or requests for extension of time for submission of documents.

Taxes Payable

All prizes shall be subject to deduction of tax (“TDS”) as per the Income Tax Act 1961. The TDS rate prescribed by the Government of India with respect to any prize money amount that is in excess of Rs. 10,000/- is 30% . With effect from 1st April 2023, TDS of 30% shall be deducted on Net Winnings (Total Winnings-(Total Entry Amount – Cash Bonus/ Discount) on each withdrawal request placed by the user. In the event, a user does not withdraw / partially withdraw any of his winnings during a financial year and has withdrawable Net Winning balance as at 31 March of each year, then TDS of 30% shall be deducted on such Net Winnings balance from the user’s Winning Account as on 31 March. In case of any revisions by the Government of India to the aforementioned TDS rate or the definition of Net Winnings in the future, TDS will be deducted by Mystart11 in accordance with the then current prescribed TDS rate and the revised definition of Net Winnings. Winners will be provided TDS certificates in respect of such tax deductions. The Winners shall be responsible for payment of any other applicable taxes, including but not limited to, income tax, gift tax, etc. in respect of the Net Winnings. Mystart11 shall not in any manner be responsible for user’s individual tax matters.

Intellectual Property

Mystart11 platform and its services include content created by Mystart11, its partners, associates, affiliates, licensors, and Users. Mystart11, its partners, licensors and associates own the intellectual property rights (“Intellectual Property Rights“) in all underlying software Mystart11 and the Mystart11 Platform and material published on Mystart11, including (but not limited to) games, Contests, written content, photographs, graphics, images, software, advertisements, illustrations, marks, logos, audio or video clippings and Flash animation. Users are prohibited from modifying, publishing, transmitting, participating in the transfer or sale of, reproducing, creating derivatives of, distributing, publicly performing or displaying, or exploiting the materials or content of Mystart11 either in whole or in part without a written license from Mystart11.
Users may seek permission to use any Mystart11 content by writing at support@mystart11.com.
Users are fully responsible for all materials they publicly posted or privately transmitted. email, or otherwise made available on Mystart11, called “Users’ Content.”
Each user shall acknowledge that they own all Intellectual Property Rights in the User’s Content and that none of its parts infringes any third-party rights. Moreover, users further confirm and undertake not to use the names, domain names, display logos, copyrights, marks, labels, trademarks, or intellectual and proprietary rights of any third party on Mystart11.
In case of any third party claims for infringement of Intellectual Property Rights arising out of display or use of the marks, names, logos, labels, trademarks, copyrights or intellectual and proprietary rights on Mystart11, by such user or through the user’s commissions or omissions, Mystart11, its directors, shareholders, employees, affiliates, and assigns will not be held liable of all costs, damages, loss and harm, including litigation costs and counsel fees.
Users with this grant Mystart11, its directors, affiliates, partners, associates, and licensors a global, irreversible, non-exclusive, royalty-free, sub-licensable license to use, create derivative works of, reproduce, publicly perform, publicly display, transfer, transmit, distribute, and/or publish Users’ Content for the following purposes:
- Displaying Users’ Content on Mystart11.
- Distributing Users’ Content, electronically or through other media, to other Users wanting to download or acquire it.
- Storing such Users’ Content in a remote database accessible by end-users for a fee.
- This license shall apply to the storage and distribution of Users’ content across medium, platform and technology.
All names, domain names. labels, logos, marks, trademarks, copyrights, or intellectual and proprietary rights on Mystart11 pertaining to Users, entities, or third parties are proprietary to the respective owners, and any complaints, claims, controversy or issues against these names, domain names, labels, trademarks, logos, marks, copyrights or proprietary and intellectual rights must be addressed directly to the respective parties under notice to Mystart11.

Third-Party Sites, Services, and APIs

Mystart11 might have hyperlinks to other third-party websites. Use of each of those sites is subject to the conditions posted by the sites. Mystart11 does not have any right or control over such third-party sites and therefore shall not be held responsible for any content on such sites. Mystart11’s inclusion of third-party content or links to third-party sites is not an endorsement by Mystart11 of such third-party sites.
Users’ correspondence or transactions or related activities with third parties, including but not limited to, verification service providers, payment providers, communication channel providers are completely between the user and that third party.
Users’ correspondence about transactions for and use of such third-party services shall be subject to such third party’s terms and conditions and policies. It shall be the user’s sole responsibility to review the same before availing of such services. The user acknowledges and agrees that Mystart11 shall not be held accountable or liable for any loss or damage incurred due to any such transactions. Any complaints or claims related to any third-party product or service should only be directed to the appropriate vendor.
Mystart11 possesses content that is created by Mystart11 as well as content provided by external third parties. Mystart11 does not warrant the accuracy, integrity, and quality of the content developed by third parties, and such content may not rely upon the Users in utilizing the Mystart11 Services.
Moreover, Mystart11 shall not be held liable and responsible for any discrepancy whatsoever in the match statistics and scores provided by such third parties.

Code of Conduct

In the event that a user does not adhere to the aforementioned Terms and Conditions or other rules, regulations and terms of use, Mystart11 shall take the following necessary corrective action, including but not limited to:

Constricting, suspending, or terminating user’s access to all or any part of Mystart11 Services;
Deactivating a User’s account and deleting all corresponding information and files on the account. The remaining unused amount in such User’s Game account or Winnings Account on the date of deactivation or deletion will be duly transferred to the user’s bank account in Mystart11’s record. A processing fee will be levied (if applicable) on such transfers.
Withholding the winning prize amount to such users.
Users shall provide accurately and keep updating their registration information.
Users shall not create more than one account with Mystart11.
Users must ensure proper receipt of marking or SMSs from Mystart11 as part of their safe senders’ list.
Mystart11 shall not be responsible if any email/SMS is missed and unread due to such messaging being delivered to the user’s junk or spam folder.
Users shall never share the password.
Users may not use anyone else’s password.
Users agree to always exit/log out of their accounts post concluding each session.
Mystart11 shall not be made responsible for any loss or damage caused due to failure to comply with these requirements.
Users agree to strictly refrain from using cheats, exploits, software, bots, automation, hacks or any unauthorized third-party software designed to interfere with or modify Mystart11 Services or Mystart11 experience or assist in doing so.
Users agree not to lease, loan, sell, copy, modify, rent, assign, distribute, grant a security interest, reverse engineer, or otherwise transfer any right to the technology or software underlying Mystart11 or Mystart11’s Services.
Users agree they shall not modify any files or software of Mystart11’s Services without Mystart11’s proper written consent.
Users agree to not partake in activities that might disrupt, overburden, aid, or assist in the same of any computer or server used to offer or support Mystart11 or the Mystart11’s server or the enjoyment of Mystart11 Services by any other User or person.
Users agree not strictly refrain from plotting, assisting or becoming a part in administering any type of attack, including, but not limited to, distribution of malware, virus, denial of service to disrupt Mystart11 Services or any other person’s experience on Mystart11.
Users shall not attempt to get unauthorized access to User accounts, Servers or networks connected to Mystart11 Services by any other means at all than the User interface offered by Mystart11, including but not limited to indulging, attempting, encouraging, or assist circumventing or modifying any security, technology, device, or software that is a part of Mystart11 Services.
Users shall refrain from publishing any content that is false and untrue and is written or published in any form to harass or mislead a person, entity or agency for financial gain or to cause an injury to any person.
Without limitation to the above, Users may refrain from using Mystart11 for the following:
- Engaging in any obscene, offensive, insensitive indecent, politically incorrect, communal, anti-national, defamatory or abusive action or communication;
- Indulging in harassing, stalking, threatening, or otherwise violating any legal rights of other individuals and creating a hostile environment for them;
- Circulating or transmitting by any medium any infringing, obscene, inappropriate, profane, indecent, banned or unlawful content;
- Transmitting corrupted files, files that contain viruses, or any other similar software or program that may be adverse to the operation of another person’s computer, Mystart11, any software or hardware, or other equipment;
- To sell and advertise services or goods for any commercial or non-commercial purpose on Mystart11 without the prior and proper written consent of Mystart11;
- To download any file or recompile, repurpose or disassemble or otherwise affect our services or products that you a or are aware or reasonably should be aware of cannot be legally obtained in such manner;
- To delete or falsify any author attributions, legal or other official notices, patented designations or labels of the origin or the source of software or any other material;
- To inhibit and restrict other users from using and enjoying any public area within our sites;
- To collect or store any sort of personal information about other users;
- To impersonate any individual or entity, including, but not limited to, a Mystart11 representative or falsely state or misrepresent your affiliation with a person or entity;
- To forge headers or distort identifiers or other data to disguise the source of any content transmitted through Mystart11 or to manipulate any user’s presence or experience on Mystart11;
- To partake in activities that cause an unreasonable or disproportionately large load on our IT infrastructure;
- You agree to use our chat areas, group chats, communities or message or communication facilities (collectively, the “Forums”) exclusively to only send and receive messages and material that are appropriate and related to that specific Forum and not to partake in any unlawful activities.
- To engage in anti-national acts that threaten the unity, integrity, defense, security or sovereignty of India or friendly relations with foreign states, cause public unrest, incitement to any cognizable offense or prevent investigation of any offense or insult other nations.
- If a user chooses a userName that is indecent, obscene abusive, or that might subject Mystart11 to public rage, disparagement or scorn, or a name that resembles an official franchise/team/league/sporting personality, then Mystart11 reserves the right, without prior notice:
  - Bar its use;
  - Change such username and intimate the user;
  - Delete such username and it’s posts from Mystart11;
  - Deny such User access to Mystart11
Users agree to access Mystart11 only through the interface provided by Mystart11. Users agree not to use any automated means, including, but not limited to, scripts, agents, robots, or spiders, to monitor, access, or copy any part of our sites, except those approved in advance by us.
Users may reach out to Mystart11 through support@mystart11.com.
Helpdesk if the user has any concerns about a match and/or contest within Forty-Eight (48) hours of winner declaration for the concerned contest.

Conditions of Participation:

By entering the Contest(s), the user is mandatorily bound by the Terms and Conditions of Mystart11.

Mystart11, at its sole discretion, may:
- disqualify any user from a Contest.
- refuse to award benefits or prizes.
- require the return of any prizes.
If the user engages in conduct that is deemed adverse by Mystart11 to the operation of the Contest or other Users, which includes, but is not limited to:
- Falsifying one’s PII (personally identifiable information) (including, but not limited to, name, email address, bank account details) or other information or documentation as may be required by Mystart11 to enter a contest and/or claim a prize/winning.
- Indulging in any sort of misrepresentation or financial fraud, such as unauthorized use of credit/debit platforms, payment wallet accounts etc., to enter a Contest or claim a prize.
- Conspiring with other user(s) or engaging in any sort of syndicate play;
- Violation of rules of the Contest or the Terms of Use;
- Using bots and automated means to accumulate points or prizes.
- Using automated means (including but not limited to bots, harvesting robots, parsers, screen scrapers, or spiders) to collect, obtain, or access any information on the Website or any user.
- Misuse of Cash Bonus misuse, Invite Friends program, or other offers or promotions.
- Fiddling with the administration of a Contest or trying to do so with Mystart11 software or any security measure associated with a Contest;
- Obtaining other users’ PII without their consent or knowledge or pamming them through unsolicited emails, bulk emails, or unwarranted email content.
- Abusing the Mystart11 in any way through unparliamentary language, slang or disrespectful words.

If the user is found to partake in such activities in the Contest(s), Mystart11 may take required Civil/Criminal actions other than forfeiture and/or recovery of prize money.

Registration for Contests

Users need to proffer the following information:

Participants must also confirm that they have read and shall abide by these Terms and Conditions.
In the event a Participant indicates while adding their address that he/she is a resident of any of the restricted states, namely Odisha, Sikkim, Andhra Pradesh, Assam, Nagaland, or Telangana, such Participant will not be permitted to proceed to sign up for any match in the paid version of the Contest.

Contest(s), Participation and Prizes

Mystart11 will host contest(s) on the Mystart11 platform.
Currently, the following contests are being hosted on the Mystart11 platform: 1) A fantasy cricket game and 2) A fantasy football game. Individual users who want to participate in such contest (“Participants”) are invited to create their own fantasy teams (“Team(s)”) consisting of real-life cricketers and footballers (as applicable) involved in the real-life cricket or football (as applicable), series or tournament (each a “Sports Event”) to which the fantasy game relates. Mystart11 offers its platform to Participants for fantasy game Contest(s) being created pertaining to each Sport Event, and Participants can participate in these Contest(s) with their Teams.
As per the circumstances of each match, participants can edit their teams until the official match commences or as per the adjusted deadline, as specified below.
Mystart11 reserves the right to discard a specific round or adjust the deadline of a round in some uncertain scenarios beyond Mystart11’s reasonable control, including but not limited to the ones mentioned below:

Football

Mystart11 shall adjust the deadline to a maximum of 10 minutes post actual match commencement time. In case the actual match exceeds 10 minutes, the contest will be abandoned.

Cricket

Mystart11 shall adjust the deadline by a maximum of 10 minutes or three overs, whichever is less, before the official match commencement time.
In instances where official match time can’t be verified by Mystart11 from reliable or publicly available sources, Mystart11 shall adjust the deadline to such a time by which a maximum of 3 overs in the given match are bowled.

The actual match start time is after the official deadline:

Mystart11 has the right to extend the deadline or abandon the game due to circumstances like the delayed toss, interruption due to weather, non-appearance or late appearance of teams, technical/equipment glitches causing delays etc.
Mystart11 shall strive to send communications regarding delays or abandonments through emails and/or SMS communication to keep the User updated.
Points will be given on the basis of the real-life cricketers’ and footballers’ performances at the conclusion of a designated match, match or tournament of the Contest(s). Moreover, the Participant(s) whose Team(s) have achieved the highest total point(s) in the Contest(s) shall be declared winners. In some pre-specified Contests, there may be more than one Winner, and the distribution of prizes to such Winners will be in increasing order of their Team’s total points at the end of the designated match(s) of the Contests.
The Contest(s) across the Mystart11 Services shall, in addition to the Terms and Conditions, rules and regulations mentioned herein, be governed by:
“Fantasy Rules” are available at How To Play – Fantasy Cricket or How To Play Fantasy Football. Other rules and regulations (including laws and regulations concerning any payments made to participate in the Contest(s) which all the Participants acknowledge and agree to.
Currently, there are two versions of the Contest(s) available on the Mystart11 platform. Practice version and Paid version. In the practice version Users can practice playing for free. In paid versions Users may take part in the Contest(s) by paying the pre-designated amount as provided on the relevant Contest page. The ‘pre-designated amount’ includes a predetermined platform fee for accessing Mystart11 services and a predetermined participant’s contribution to the prize money pool. The Participant with the maximum total points at the conclusion of the predetermined match shall be qualified to win a pre-designated prize which is paid out of the prize money pool.
A Participant may create multiple teams for participation in Contest(s) in relation to a Sports Event across the Mystart11 Services. However, unless Mystart11 specifies otherwise in relation to any Contest (“Multiple Entry Contest”), participants agree that they might enter only one team in any Contest offered concerning a Sports Event. In the case of Multiple Entry Contest(s), a Participant may enter more than one team in a single Multiple Entry Contest. In addition, it is expressly clarified that Mystart11 may restrict the maximum number of Teams, as and when needed, that might be created by a single user account (for each format of the Contest) or which a single User account might enter in a specific Multiple Entry Contest, in each case to such number as determined by Mystart11 in its sole discretion.
Participants shall pay a pre-designated amount for taking part in the Contest(s) created on the Mystart11 platform.
In public contests with two members and above, wherein all participants have added themselves to the Contest with the same exact teams, including the captain and vice-captain in such cases, the prize money will be equally divided amongst all participants, and the amount shall be deposited in the Mystart11 winning account of all participants. The remaining amount will be credited to the Cash Bonus account of the participants. In an event where the User is found to violate this policy, the Company holds the right to take any appropriate action against them as it deems fit, which might also include forfeiture of the Cash Bonus Amount.
In Starting Lineup Feature: The purpose of indicating a player’s inclusion in the final starting lineup is only to provide information and assist a User in selecting his/her team on Mystart11. While indicating a Player’s inclusion in the starting lineup is given by Mystart11 based on information/data received through feed providers, publicly available information. Users are advised to do thorough research of their own from official sources and/or other available sources of information. Mystart11 should not take any liability if a player indicated earlier as ‘Playing’ does not play or start for any reason.
On-field substitutes will not be awarded points for any contribution they make. However, ‘Concussion and COVID-19 Substitutes’ will be awarded four (4) points for making an appearance in a match and will also be awarded points for any contribution they make as per the Fantasy Points System.

Contest Formats

Two formats of the Contest(s) are available on the Mystart11 platform currently
- Public Contest: here, Users, without any restriction on participation, can participate in a Contest with other Users, and
- Private contests: where Users can participate in the Contest only with an invite by other participants.
A User can enter both the Contests single (S) or multiple (M) times as mentioned in the Contest. The number of entries allowed in case of multiple entries shall also be mentioned in the Contest. Any participation in a contest of more than 500 shall be automatically prohibited. All rules mentioned in terms and conditions shall apply to both Contest formats(s). By participating in a Contest(s), Users automatically authorize Mystart11 to appoint a third party/ Trustee/Escrow Agent to manage Users’ funds on their behalf.

Public Contest

Mystart11 may make available the Contest(s) comprising 2 or more participants or any other pre-decided number of Participants.
Mystart11 may run this Contest(s) in a paid format, and the Winner will be determined at the end of the match as per the set rule.
The number of participants needed to commence the Contest(s) operational will be pre-specified. If not, the collection shall be refunded as is to the participants.
In certain Contests called “Guaranteed contests,” the Contest(s) shall begin only when a minimum of two Users join. The pre-specified number of winners will be declared, even if all available Participant slots (as pre-specified concerning the Contest(s)) remain unfilled. Further, notwithstanding the activation of such Contest(s), Participants can continue to join such Contest(s) till:
- all available Participant slots of such Contest(s) have been occupied or
- the match to which the Contest(s) relates starts, whichever is earlier.
In the event of a shortfall in the number of participants joining the Guaranteed Contest, Mystart11 shall continue with such contests, and the shortfall in the prize pool shall be borne by Mystart11.

Private Contest

Mystart11 lets Users create a private Contest and invite other users, either existing or otherwise (“Invited User “) to form Teams and participate in the Contest(s).
Users may create a Private contest to consist of a pre-decided number of Participants from 2 to 20,000 Participants.
The User creating the Private Contest shall be obliged to pay the pre-decided and also supply a name for the Private Contest and will be then assigned a unique identification code (“contest Code”) (which will be allocated to the account of such User). The User understands and agrees that once the Private Contest is created, no changes shall be entertained in the terms or constitution of the Private Contest. The User creating the Private Contest can invite users through email, SMS, messaging apps, and more.
To participate in the Private Contest, an Invited User shall enter the private contest code associated with the Private Contest and then pay the pre-decided amount for the Private Contest. Once the number of participants in the Contest equals the number of pre-specified ones, the Private Contest shall be rendered operative, and no other Invited Users or Users shall be permitted to participate in the Private Contest. If any Private contest does not contain the pre-specified number of Participants for that Private Contest within 1 hour before the commencement of the match/Contest, the platform will initiate an automatic refund of the amount deposited. Such refund shall be processed after the deadline’s expiry for filling participants for such a Private Contest.

Publicity

Acceptance of a prize by the Winner constitutes permission for Mystart11, and its affiliates to use the Winner’s name, likeness, voice and comments for advertising and promotional purposes in any media worldwide for purposes of advertising and trade without any further permissions or consents and / or additional compensation whatsoever.

The Winners further undertake that they will be available for promotional purposes as planned and desired by Mystart11 without any charge. The exact dates remain the sole discretion of Mystart11. Promotional activities may include but not be limited to press events, internal meetings and ceremonies/functions.

Dispute and Dispute Resolution

The competent courts of Ahmedabad shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the Mystart11 Services provided by Mystart11 (including the Contest(s)), the compilation, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the User(s) (including Participants) or Mystart11, and the exclusive jurisdiction to grant preliminary or interim consolation in case of any dispute referred to arbitration as given below in accordance with the Indian Constitution.
In case of any legal dispute, the Party raising the dispute shall send a written notification to the other Party. On receipt of the same, both parties shall try to solve the issue through discussion and mutual understanding within 15 days or else the dispute shall be escalated to the arbitration for settlement.
The place of arbitration shall be Ahmedabad, India. All arbitration proceedings shall be achieved in English and according to the Arbitration and Conciliation Act, 1996.
The arbitration award shall be final and binding on all Parties. Each Party shall endure its costs of arbitration and share the arbitrator’s fees equally unless the arbitral tribunal decides otherwise.
The arbitrator shall pass interim awards and orders which would be enforceable in competent courts. The arbitrator will give a well-reasoned award.
Nothing contained in these Terms and Conditions helps prevent Mystart11 from obtaining and seeking interim or permanent equitable or injunctive relief or any other available relief to safeguard its interest prior to, during or following the filing of arbitration proceedings or pending the execution of a decision or award in connection with any arbitration proceedings from any court having jurisdiction to grant the same. The pursuit of equitable or injunctive relief shall not constitute a waiver on the part of Mystart11 to pursue any remedy for financial damages through the arbitration described here.

Release and Limitations of Liability

Users shall access the Mystart11 Services provided on Mystart11 voluntarily and at their own risk. Mystart11 shall, under no circumstances, be held responsible or liable for any loss or damage sustained, including but not limited to any accident, injury, death, or loss of property) of Users or any other person or entity during their tenure accessing Mystart11 Services (including participation in the Contest(s)) or acceptance of any prize
By entering the contests and using the Mystart11 Services, Users release the form and agree to indemnify Mystart11 and any of its partners, directors, employees, associates and licensors from and against all loss, liability, cost, or expense arising out of their access to the Mystart11 Services including, but not limited to, damage to property, personal injury, and whether consequential, foreseeable, direct, indirect, due to some negligent act or omission on their part, or otherwise.
Mystart11 accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties concerning the prizes.
Users shall be solely and completely responsible for any consequences arising from their access to Mystart11 Services by administering an illegal act or due to non-conformity with these Terms and Conditions and other rules and regulations in relation to Mystart11 Services, including the provision of incorrect address or other personal details. Users also indemnify Mystart11 and their respective officers, directors, employees and agents in the instance of such an event, including but without limitation to the cost of an attorney, legal charges etc. on a full indemnity basis for any loss/damage suffered by Mystart11 on account of such activity on the part of the Users.
Users shall defend, hold, and indemnify Mystart11 harmless from any third party/entity/organization claims arising from or related to such User’s engagement with the Mystart11 or participation in any Contest. In no event shall Mystart11 be responsible to any User for omissions or acts arising out of or concerned to the User’s engagement with the Mystart11 or his/her participation in any Contest(s).
In consideration of Mystart11 allowing Users to access the Mystart11 Services, the Users waive off every claim, all actions, causes of actions (present or future) they have or may have against Mystart11, its directors, agents, officers, business associates, sponsors, employees, group companies, or representatives due to any injuries, accidents, or mishaps (known or unknown) or (anticipated or unanticipated) arising out of the provision of Mystart11 Services or related to the Contests or the prizes of the Contests.

Disclaimers

Mystart11 or its parent company, subsidiaries, affiliates, directors, officers, professional advisors, and employees are responsible for the deletion, the failure to store, the misdelivery, or the untimely delivery of any information or material to the extent permissible by law.
Further, Mystart11 shall not be liable for any harm resulting from accessing or downloading any information or material from the Mystart11 services or sites.
Mystart11 will not be responsible for paying a refund to a User who is unable to access Mystart11 due to server maintenance or any technologies that underlies our sites, failures of Mystart11’s service providers such as telecommunications, hosting, and power providers, and from natural disasters, computer viruses, acts of war, nature, or other destruction or damage of our facilities, civil disturbance, or any other cause beyond our reasonable control. In addition, Mystart11 does not provide any warranty on the content on the Mystart11 as the content is distributed on it on an “as is, as available” basis.
The User is solely responsible for any damage that occurred to their computer or data loss after accessing or downloading any material through Mystart11.
Mystart11 shall make its best endeavors to ensure that the Mystart(s) is error-free and secure. However, neither Mystart11 nor any of its partners, licensors or associates makes the following warranties:
- Mystart11 will be timely, uninterrupted, secure, or error-free 24/7;
- Results obtained from the use of Mystart11 will be accurate or reliable;
- The quality of any products, Mystart11 Services; information, or other material that Users purchase or obtain through www.mystart11.com will meet Users’ expectations.
In case of Mystart11 spots any error in the determination of Winners or in the transfer of amounts to a User’s account, Mystart11 will rectify the error (exercisable at its discretion) in a manner it deems best for all, including by setting off the erroneous payment from amounts due to the User or deducing from the User’s account the amount of erroneous payment. In case of conducting a remedial exercise in accordance with this clause, Mystart11 will notify the User of the error and of the exercise of the remedy(ies) to rectify the same.
Mystart11 nor its partners, licensors or associates will be held liable for any incidental, special, direct, indirect, or consequential damages resulting due to the use of or inability to use our sites, even if we have been advised of the possibility of such damages.
Any Mystart11 Services, events or Contest(s) being hosted or provided, or intended to be hosted on the Mystart11 platform and requiring specific permission or authority from any statutory authority or any state or the central government, or the board of directors shall be deemed canceled or terminated if such permission or authority is either not obtained or denied either before or after the availability of the relevant Mystart11 Services, events or Contest(s) are hosted or provided.
To the extent permitted under law, in the event of suspension or closure of any Services, events or Contests, Users (including Participants) shall not be entitled to make any demands, or claims, of any nature whatsoever.

Miscellaneous

Under specific legislation, Mystart11 needs to notify User(s) of certain events. This shall be done by posting them on Mystart11 or delivering them to the User through the registered email address.
Mystart11 shall not be liable for any delay or failure to optimally perform due to uncontrollable external causes like acts of war, terrorism, embargoes, acts of civil or military authorities, fire, floods, riots, accidents, strikes, network infrastructure failures or shortages of transportation facilities, energy, fuel, labor or materials or any cancellation of any cricket or football match to which a Contest relates. Mystart11 shall be entitled to cancel any related Contest(s) and to process an appropriate refund for all Participants in such cases.
In rare cases where Mystart11 fails to enforce or exercise any of these Terms and Conditions, rules and regulations shall not constitute a waiver of such right or provision.
Users agree that any claim related to the use of the Mystart11 or these Terms must be filed within thirty (30) days of arising of such claim, or the claim shall be forever barred.
These Terms and Conditions, including all terms, conditions, and policies that are incorporated by reference, constitute the entire agreement between the User(s) and EDDBEE Technologies Private Limited and regulate your use of Mystart11, superseding any prior agreements that any User might have with EDDBEE Technologies Private Limited.
Mystart11 may permanently close or temporarily suspend any Mystart11 Services (including any Contest(s)) at its sole and absolute discretion.
Two or more promotions cannot be clubbed with any other promotion(s) running simultaneously on the Mystart11 platform.
The promotions or offers cannot be clubbed with the Cash Bonus of any User.

Miscellaneous (Prizes Related)

Mystart11 makes no representations or warranties for the quality, suitability or merchantability of any winning prizes offered.
Mystart11 may, at its sole and absolute discretion, vary or modify the prizes being offered to winners.
All prizes are non-transferable and non-refundable, non-exchangeable, and non-redeemable for cash or kind.
The Winners shall bear all transaction fees levied on cash prizes.

The Mystart11 Invite Buddies Program lets you invite friends to join Mystart11 (“Program”). As a result, you earn a Cash Bonus of up to Rs. 200(“Bonus Amount”), which will be redeemable to join cash contests and contests through the Mystart11’s mobile application for both iOS and/or Android mobile devices (“Mystart11 Application”). Here are the Invite Buddies terms and conditions to govern your participation in the Program:

All Users above 18 years of age, with a registered Mystart11 account, not residing in the restricted states, and downloading the Mystart11 app are eligible for the Invite Buddies program.
Participation in the Program is voluntary.
Participation by Proxy in the Program is not permitted.
Registering or operating from more than one user account is prohibited.
To participate in the Program, you must have a Mystart11 Application downloaded and installed on your mobile device. Through the Mystart11 Application, you will be provided with a unique link or code, which you can share (“Inviter”) with friends (each an “Invitee”) to invite such friends to create and register an account with Mystart11 and download the Mystart11 Application. On receiving the code or link, the Invitee may either:
- Click on it, consequent to which he/she will be directed to a registration page and will be provided the option to register an account with Mystart11 and download and install the Mystart11 Application on his or her device; or
- download and install the Mystart11 Application on his/her device independently, register for a Mystart11 account through the Mystart11 Application and enter the unique code-shared by the Inviter where prompted in the Mystart11 Application.
The Inviter and the Invitee shall be eligible to earn the Bonus along with other prerequisites:
- the Invitee should not be an existing User of Mystart11; and
- the Invitee, as well as the Inviter, should be eligible to participate in the pay-to-play Mystart11 fantasy cricket, or fantasy football game; and
- the Inviter and Invitee mutually agree to the license agreement for the Mystart11 Application and downloading and installing the Mystart11 Application as available for the Inviter’s and Invitee’s respective mobile devices. For these Terms, an ‘existing User of Mystart11’ means a User who currently uses an account with the Platform or using an account with the Platform at any point in time.
An Invitee who already is a User of Mystart11 is barred from registering for a new account to avail the Bonus Amount or otherwise. Mystart11 will determine in its sole discretion whether an Invitee is an existing User of Mystart11 or not and take appropriate action.
In an event when the Invitee opts to register for a Mystart11 account through the Mystart11 App, the Invitee can verify his or her contact information at the time of registration.
The verification process may need an Inviter/Invitee to submit personal information about the User (Inviter/Invitee) and documents identifying the Inviter/Invitee. The Inviter agrees to receive communication from Mystart11 and to allow Mystart11 to effectively communicate with Invitees regarding the Inviter’s participation in the Invite Buddies Program.
Any information collected and stored by both parties shall be binding to Mystart11’s Privacy Policy.
The verification of both parties shall be successful during the first withdrawal by either of them from the Winnings Account. They may voluntarily verify themselves by clicking on My Balance Page -> Winnings Tab -> Verify Now.

Inviter Bonus
In order for an Inviter to be eligible for the Inviter Bonus, the Inviter must also download and install the Mystart11 application on his or her mobile.

The amount of the Inviter Bonus is dependent on the Invitee’s deposit of any Amount in its Unutilised Account and then using it to participate in cash contests on Mystart11. The Inviter shall get 10% up to INR 500 of the deposit amount used by the Invitee to join a cash Contest on Mystart11.
The applicable Inviter Bonus for an Inviter shall be credited to the Inviter’s Cash Bonus Account from fifteen (15) days of the conclusion of the cash Contest.
Inviter will be eligible to receive the Inviter Bonus only in the event the winners are declared for such contests. In case the Contest entry amount paid by the Invitee is refunded to the Invitee with respect to any cash contest, for any reason whatsoever, the Inviter shall not receive any Inviter Bonus for such Contest(s).
The bonus amounts credited to the Inviter can be used to join cash contests and contests offered by Mystart11. Bonus Amount can not be used to join and participate in private contests. They cannot be withdrawn or transferred to any other cash balance account held by the Inviter/Invitee with Mystart11 or to any third-party account, or to any bank/payment instrument account.
Use the bonus amount within the number of days as mentioned in the coupons.
Depositing the Bonus Amount shall be at the sole discretion of Mystart11 and be subject to the Inviter’s/Invitee’s compliance with these Terms.
Mystart11 may change or substitute the Bonus Amount proffered without prior notice. An Inviter may not substitute the amount of Bonus Amount or substitute offers for other items or exchange for cash.
Mystart11 reserves the right to:
- withhold the deposit of the Bonus Amount; and/or
- withhold any deposited Bonus Amount to an Inviter/Invitee or any winnings earned by the participant by using such Bonus Amount; and/or
- In case of terms and conditions violation, the accounts of the Inviter/Invitee can be deactivated.
Only participation in the Program does not qualify the Inviter to receive any Bonus Amount.
The decision of Mystart11 shall be final and binding corresponding to the Program, and no objection, complaints, correspondence, etc., shall be entertained in this regard.

Mystart11 reserves the right to alter or discontinue the Invite Buddies Program without any prior notice to the participants.
Mystart11 shall not promise to respond to any suggestion, feedback, or queries of the participants.
The Terms and Conditions applicable to the Invite Buddies program will be the same as the terms and conditions of Mystart11’s fantasy games and services.
Notwithstanding anything contained here, the total liability of Mystart11 to participants in relation to the Program whatsoever shall not exceed Rs.200.

Modifications and Alterations

In cases of major changes and alterations in Mystart11 terms and conditions, Mystart 11 whenever necessary shall alert Users through registered email address or posting notifications in the User accounts where the User can indicate non-acceptance of such modifications. Users shall do so within a stipulated time frame or the terms and conditions will be deemed to have been accepted. However, our notification of any change shall not waive your obligation to keep yourself updated about the changes in the Terms. Your continued use of any Portal or any Services offered constitutes your unconditional acceptance of the modified or amended Terms.
